Grounds for Divorce – Divorce Lawyer in Toronto

Section 8(2) of the Divorce Act provides the grounds for a divorce in Canada. Under the Act, a breakdown of a marriage is recognized in Canada only if:

  1. The spouses have lived separately for at least a year before the proceedings and were apart at the start of the proceedings. OR
  2. A spouse brings a divorce proceeding against a spouse who has committed adultery against the former, or, treated the former with physical or mental cruelty so as to make the cohabitation intolerable.

Contested or Uncontested Divorce in Toronto

An uncontested divorce, on the one hand, signifies that spouses both agree on all terms regarding the separation and divorce, including: child support, child custody and access arrangements, spousal support, and property and debt division. An uncontested divorce will not require you to appear in Court. A judge signs an order of divorce that incorporates the spouses’ terms.

A contested divorce, on the other hand, signifies that spouses do not agree on the same divorce or separation terms, which may be related to money issues, parenting time or custody matters. When an uncontested divorce is impossible, we do what is necessary to protect your rights through litigation.
