Divorces in Canada and Ontario are governed by the Divorce Act. Separating, however, and claiming for child support, spousal support, child custody (or “decision making power”) and access or division of property is governed by multiple statutes including the Family Law Act of Ontario, the Children’s Law Reform Act of Ontario, the Family Law Rules of Ontario and other relevant regulations. Certain cases implicate a Children’s Lawyer, the Children’s Aid Society and other agencies. The intersection between all of these Laws and Regulations causes clients enormous confusion. At times when urgent family needs risk being jeopardized, it is best to avoid falling into common loopholes which family lawyers will advise you against. As you navigate through this process, a family lawyer will hold your hand and guide you through the best strategies to achieve your goals in the most efficient and peaceful way possible which leads to a speedy yet effective resolution. If you try to navigate a complicated process yourself by attempting to save money, you could ultimately end up losing much more money than initially necessary had you been properly represented by a family lawyer.
Rana Charif is specialized in high conflict resolution which results in a fruitful negotiation stage. Family law negotiations set the stage for what is to come, it thus is important to approach your first negotiations properly, especially as judges insist on negotiation efforts when proceeding to litigation. Consult with a Toronto divorce lawyer before you take any further steps so that you fully understand your rights, obligations and legal options.
Section 8(2) of the Divorce Act provides the grounds for a divorce in Canada. Under the Act, a breakdown of a marriage is recognized in Canada only if:
Consult a family lawyer to properly calculate your separation time as interruptions may affect these provisions.
An uncontested divorce, on the one hand, signifies that spouses both agree on all terms regarding the separation and divorce, including: child support, child custody and access arrangements, spousal support, and property and debt division. An uncontested divorce in Toronto may cost around $2,500.00. Contact a divorce lawyer by calling 647 806 9184.
An uncontested divorce will not require you to appear in Court. A judge signs an order of divorce that incorporates the spouses’ terms.
A contested divorce, on the other hand, signifies that spouses do not agree on the same divorce or separation terms, which may be related to money issues, parenting time or custody matters. When an uncontested divorce is impossible, we do what is necessary to protect your rights through litigation.
